A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to face human smuggling charges, he was detained in federal detention.
In her decision, the court pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
The court challenge involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.
The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now comply with the conditions of his release from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
